Washroom Services Legislation

From The 1st April 1992 all employers have a legal responsibility to ensure that ladies sanitary waste is correctly disposed of.

The Duty of Care of the Environmental Protection Act means that waste producers will need to review their disposal practices and abide by the correct guidelines.

Should waste from sanitary or medical bins be found by the authorities not to be disposed of in accordance with the guidelines or legislation then you and your business could be convicted under section 33-34 and may be imprisoned or an unlimited fine.

The Collection and Disposal of Waste Regulations 1988 defines sanitary waste under the category of Clinical Waste. This is because it contains blood and body fluids. These guidelines issued by the Department of the Environment and London Waste Authority state the only acceptable way of disposing of clinical waste is by high temperature incineration.

You are also advised to ensure that the company Collecting/Disposing the clinical waste is a registered waste carrier.
